Preamble
The General Terms and Conditions of Sale described below detail the rights and obligations of Légumes Perchés and its Customer in connection with the provision of the following services: gardening workshops. Any service provided by Légumes Perchés implies the buyer’s tacit and unreserved acceptance of these General Terms and Conditions of Sale.
The General Terms and Conditions of Sale are made available to the Customer on the Site, where they can be consulted directly, and can also be communicated to the Customer on request by any means.
Entry into force
The present General Terms and Conditions of Sale enter into force as soon as the Customer has initiated the use of the service by Légumes Perchés, in other words as soon as the Customer has signed the accompanying contract.
Services
The various services provided by Légumes Perchés are explicitly communicated on the Légumes Perchés website. The Customer may refer to this information at any time to find out about the various services offered. Légumes Perchés is responsible for the quality of the service. A feedback form will be provided after each workshop.
Products and Services
The products and services offered by Légumes Perchés, i.e. the design, creation and support of edible spaces, are presented on the legumesperches.ch website, together with their associated characteristics. The characteristics set out are only a very general description of the product and Légumes Perchés cannot guarantee the exact understanding of each. Once a service or product has been signed, no type of refund or change for a zero price will be accepted.
The customer must register in advance on the Site (legumesperches.ch) for the workshops he/she wishes to attend during the year. s
Liability and Warranty
Légumes Perchés cannot be held liable if the non-performance or delay in the performance of any of its obligations described in these General Terms and Conditions of Sale is due to the customer’s fault or to an event qualified as force majeure by the competent courts, or to the unforeseeable and insurmountable fault of any third party to these General Terms and Conditions of Sale.
Prices and invoicing
The prices of services rendered are those in force on the day the order is taken and are denominated in Swiss francs. Légumes Perchés reserves the right to modify its prices at any time. However, it undertakes to invoice the services at the prices indicated when the order is placed.
In the event of a promotion, Légumes Perchés undertakes to apply the promotional price to all orders placed during the promotional advertising period.
The price is payable by cash and/or bank transfer, and/or by TWINT and exclusively in Swiss francs. The price is payable in full once the service or product has been delivered to the Customer.
The Customer expressly acknowledges that any order placed with Légumes Perchés is an order with an obligation to pay, which requires the payment of a price against the service or product ordered. Payment of the invoice in 3 installments without charge is possible under the following conditions:
– 1st payment, on the day of signature or on receipt of the invoice: 50% of the amount.
– 2nd payment, 30 days after signing the contract: 25% of the amount
– 3rd payment, 60 days after contract signature: 25% of the invoice amount
Contract formation and withdrawal
The contract created by Légumes Perchés with a view to providing the Customer with a service in return for payment is formed when the Company and the Customer define the date, time and place. The Customer may terminate the contract at any time, but is obliged to make payment when the contract is signed. The customer is not reimbursed; the sum paid includes the service for one year. This is to cover the projected costs of the urban farmer.
General Provisions and Entire Agreement of the Parties
These General Terms and Conditions of Sale constitute a contract governing relations between the Customer and Légumes Perchés. They constitute the entirety of the rights and obligations of the Company and the Customer relating to their subject matter. If one or more stipulations of these General Terms and Conditions of Sale are declared null and void in application of a law, regulation or following a final decision by a competent court, the other stipulations will retain their full force and scope. In addition, the fact that one of the parties to these General Terms and Conditions does not invoke a breach by the other party of any of the provisions of these General Terms and Conditions shall not be construed as a waiver on its part to invoke such a breach in the future.

Modification of conditions
Légumes Perchés reserves the right to modify at any time and without notice the content of the Site or the services available on it, and/or to cease temporarily or permanently to operate all or part of the Site.
In addition, Légumes Perchés reserves the right to modify the location of the Site on the Internet at any time and without notice, as well as these General Terms and Conditions of Sale. The Customer is therefore required to refer to these General Terms and Conditions of Sale before using the Site.
The Customer acknowledges that Légumes Perchés may not be held liable in any way whatsoever to the Customer or to any third party as a result of these modifications, suspensions or cessations.
Légumes Perchés advises the Customer to save and/or print the present General Terms and Conditions for safe and durable storage, and to be able to invoke them at any time during the performance of the contract if necessary.
Acceptance of the General Terms and Conditions by the customer
The customer acknowledges having carefully read the present General Terms and Conditions.
The General Terms and Conditions applicable to the Customer are those available on the date of the order, a copy of which dated to that date may be given to the Customer on request. It is therefore specified that any modification of the General Terms and Conditions made by Légumes Perchés will not apply to any order placed previously, except with the express agreement of the Customer at the origin of a given order.
Personal data
The personal data that the Company collects from the Customer may include: Surnames and first names, e-mail address, postal address, telephone number. Légumes Perchés undertakes to protect the Customer’s personal data. The Company undertakes not to divulge to third parties, whether free of charge or in exchange for payment, any information provided by the Customer. This information is confidential. It will only be used to process the Customer’s order and to reinforce and personalize the communication of products reserved for Légumes Perchés customers.
Place of jurisdiction
All disputes arising from the interpretation and execution of these General Terms and Conditions of Sale are subject to Swiss law.
Complaints or disputes will always be received with attentive benevolence, good faith always being presumed in those who take the trouble to expose such situations. In the event of a dispute, the customer will first contact the company to seek an amicable solution.
Failing amicable resolution, the dispute will be referred to the Lausanne Court.

Any service provided by Légumes Perchés therefore implies the Client’s full and unreserved acceptance of these General Terms and Conditions of Sale.
The General Terms and Conditions of Sale are made available to the Client on the Website, where they can be directly consulted and may also be provided upon request by any means.
Effective Date
These General Terms and Conditions of Sale become effective as soon as the Client initiates the use of the service provided by Légumes Perchés, i.e., as soon as the support contract is signed.
3. Liability and Warranty
Légumes Perchés cannot be held liable if the non-performance or delay in the performance of any of its obligations described in these General Terms and Conditions results from the Client’s actions, an event recognized as force majeure by the competent courts, or an unforeseeable and insurmountable act by any third party to these terms.
4. Pricing and Invoicing of the Service
The service prices are those in effect on the date of the order and are stated in Swiss francs. Légumes Perchés reserves the right to modify its prices at any time. However, it undertakes to invoice the services at the prices indicated at the time the order is recorded.
In the event of a promotion, Légumes Perchés commits to applying the promotional price to any order placed during the promotional period.
Payment is to be made via bank transfer and/or TWINT, exclusively in Swiss francs. The full amount is due upon registration for the course.
The Client expressly acknowledges that any registration made with Légumes Perchés constitutes a binding order with an obligation to pay, requiring payment in exchange for the requested service or product.
5. Cancellation
In the case of cancellation, only written requests or those sent by email will be accepted. The following fees are due as a percentage of the total course price:

25% if cancellation is made 8 to 14 days before the course start date

50% if cancellation is made 1 to 7 days before the course start date

100% if the participant does not attend the course
Upon presentation of a medical certificate or in the case of force majeure (at the discretion of Légumes Perchés management), no cancellation fees will be charged.
If a course is canceled by Légumes Perchés, you will be notified no later than 7 days before the course start date. The participant will not be entitled to any compensation (except a refund if payment has already been made).
6. General Provisions and Entire Agreement
These General Terms and Conditions of Sale constitute a contract governing the relationship between the Client and Légumes Perchés. They represent the full extent of the rights and obligations of the Company and the Client concerning their subject. Should one or more provisions of these Terms be declared null and void under applicable law, regulation, or a final court decision, the remaining provisions will retain their full force and effect. Furthermore, failure by either party to enforce any provision of these Terms shall not be interpreted as a waiver of their right to enforce such provision in the future.

8. Modifications to the Terms
Légumes Perchés reserves the right to modify, without prior notice and at any time, the content of the Website or the services available there, and/or to temporarily or permanently cease operation of all or part of the Website.
Additionally, Légumes Perchés reserves the right to change, without prior notice, the location of the Website on the Internet as well as these General Terms and Conditions of Sale. The Client is therefore required to consult these Terms before using the Website.
The Client acknowledges that Légumes Perchés shall not be held liable in any way to them or to any third party for such modifications, suspensions, or terminations.
Légumes Perchés advises the Client to save and/or print these General Terms and Conditions for secure and lasting record-keeping and to be able to refer to them at any time during the contract’s execution if needed.
9. Acceptance of the General Terms by the Client
The Client acknowledges having read these General Terms and Conditions carefully.
The Terms applicable to the Client are those available on the date of the order, and a dated copy may be provided upon request. Any modification of the Terms made by Légumes Perchés shall not apply to prior orders unless expressly agreed to by the Client.
10. Personal Data
The personal data that the Company may collect from the Client may include: full name, email address, mailing address, and phone number. Légumes Perchés is committed to protecting the Client’s personal data. The Company undertakes not to disclose the information provided by the Client to third parties, whether for free or for payment. This data is confidential and will only be used for processing the Client’s order and to enhance and personalize communication regarding products reserved for Légumes Perchés clients.
11. Jurisdiction
Any dispute relating to the interpretation or performance of these General Terms and Conditions of Sale is subject to Swiss law.
Complaints or disputes will always be welcomed with attentive goodwill, as good faith is always presumed in anyone who takes the time to explain their situation. In case of a dispute, the Client shall first contact the company to seek an amicable resolution.
If no amicable resolution is found, the dispute shall be brought before the Court of Lausanne.
